TERMS AND CONDITIONS

ARTICLE 1 – DEFINITIONS

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer can exercise the right of withdrawal.
Consumer: the natural person who does not act in the course of a profession or business and enters into a distance contract with the entrepreneur.
Day: calendar day.
Durable medium: any tool that enables storage of information in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person offering products and/or services at a distance.
Distance contract: a contract concluded using only remote communication techniques.
General Terms and Conditions: these Terms and Conditions of JIHANA.

ARTICLE 3 – APPLICABILITY

These Terms apply to all offers, orders, and agreements between JIHANA and the consumer.

The Terms are made available before the agreement is concluded. If this is not possible, it will be indicated where they can be accessed.

If the agreement is concluded electronically, the Terms will be made available in a way that allows storage on a durable medium.

If any provision is invalid, the remaining provisions remain fully applicable.

ARTICLE 4 – THE OFFER

All offers are non-binding. JIHANA may change or adjust prices, products, or offers at any time.

Product descriptions are as accurate as possible. Minor errors do not bind JIHANA.

ARTICLE 5 – THE AGREEMENT

The agreement is concluded once the consumer accepts the offer and meets the conditions.

JIHANA will confirm each order electronically.

JIHANA may refuse or cancel orders at its discretion.

ARTICLE 6 – RIGHT OF WITHDRAWAL

Consumers have the right to withdraw within 14 days without giving any reason.

Products must be returned in original condition where possible.

The withdrawal period starts on the day of delivery.

ARTICLE 7 – COSTS IN CASE OF WITHDRAWAL

Return costs are paid by the consumer unless stated otherwise.

Refunds will be made within 14 days after withdrawal, provided proof of return is received.

The consumer is responsible for any loss in value caused by improper handling.

ARTICLE 8 – EXCLUSION OF RIGHT OF WITHDRAWAL

The right of withdrawal may be excluded for:

  • Custom-made or personalized products
  • Sealed items once opened
  • Hygiene products after opening
  • Products that cannot be returned for safety or hygiene reasons

ARTICLE 9 – THE PRICE

All prices are in euros (€) and include VAT unless stated otherwise.

Prices may change due to legal requirements.

ARTICLE 10 – CONFORMITY AND WARRANTY

Products must match the agreement and reasonable expectations.

Defects must be reported within 2 months with proof.

Warranty does not apply in cases of misuse, modification, or external damage.

ARTICLE 11 – DELIVERY AND EXECUTION

Orders are shipped to the address provided by the customer.

Delivery times are indicative.

If delivery fails, the customer will be informed and may cancel.

Risk transfers upon delivery.

ARTICLE 12 – LONG-TERM AGREEMENTS

Consumers may cancel long-term agreements with up to 1 month notice.

No automatic renewal unless legally allowed.

ARTICLE 13 – PAYMENT

Payments must be completed during checkout.

Non-payment may result in cancellation of the order.

ARTICLE 14 – COMPLAINTS PROCEDURE

Complaints must be submitted within 2 months of discovery.

Response time is within 14 days.

ARTICLE 15 – DISPUTES

Only Dutch law applies.

ARTICLE 16 – ADDITIONAL PROVISIONS

All additional agreements must be recorded in a durable format.
